Congratulations to Samantha Adams and the A+C Team on a big appellate win for New Mexico public schools. The Tenth Circuit Court of Appeals reversed and remanded the New Mexico District Court’s erroneous ruling against public school efforts to seek attorney’s fees after prevailing in meritless IDEA actions brought by parents and their advocates. In a forthcoming published opinion on regulatory interpretation, the Tenth Circuit has reaffirmed the policy right of a school district to pursue fees under the Individuals with Disabilities Education Act (IDEA), explaining that the “fee shifting” provisions of the IDEA and the New Mexico Administrative Code are “neutral” and not only intended to favor parents. This language should encourage school districts to continue to challenge baseless IDEA claims, where appropriate, and to protect public money and resources in the interest of serving all public school children.
